Conditions of Participation

Conditions of participation of Youngcom GmbH in the competition as part of the YoungBrandAwards voting.

1st item
1.1 These conditions of participation and the associated data protection notices regulate participation in the competition by Youngcom GmbH, Marktstrasse 10, 33335 Gütersloh (hereinafter: Youngcom) as part of the betteract voting and the YoungBrandAwards by the participants and the collection and use of the participants data collected or communicated.
1.2 By participating in one of the above competitions, participants accept these conditions of participation.

2. Conditions of Participation
2.1 The YoungBrandAwards voting/competition begins on May 1st of each year at 12:00 noon.
2.2 The closing date for entries is 1 October at 12:00 noon.
2.3 Only natural persons residing in Germany are entitled to participate. Excluded are employees of Youngcom as well as employees of cooperation partners and participating companies who are or were involved in the creation or processing of the competition. Sweepstakes clubs, automated entries via sweepstakes robots, as well as deliberate false entries and entries with so-called "disposable e-mail addresses" are also not permitted.
2.4 Participation takes place through participation and through a complete voting (hereinafter: voting) on the website www.youngbrandawards.com.
2.5 Participation in the voting is free of charge and non-binding.
2.6 Each participant can only vote once. This means that only one participation is possible per participant and e-mail address, multiple participation in the voting is excluded.
2.7 Participation in the raffle and competition is always free of charge. And regardless of what was voted on or how it was rated.
2.8 Various cash prizes and various company prizes will be raffled off among all participants.
2.9 Legal recourse is excluded.

3. Sweepstakes processing
3.1 The winners will be determined by lottery, closed to the public.
3.2 A payout of the prize in cash, in kind, its exchange or its transfer to other persons is not possible. The participant can forego the prize. In this case, the next participant in the winner's ranking takes his place. The handover of the prizes will be coordinated individually with the participants.
3.3 Participants will be notified of the prizes by Youngcom within 8 weeks of the end of the competition by email to the email address provided after the voting has been completed and they will be asked to confirm within four weeks.
3.4 If a participant does not confirm acceptance of the prize within a period of 4 weeks, the right to the prize expires. If the specified contact options are incorrect (e.g. invalid e-mail address), Youngcom is not obliged to research correct addresses. The disadvantages resulting from the provision of incorrect contact details are at the expense of the participants. The right to the prize also lapses if the prize cannot be sent within 8 weeks of the first notification of the prize for reasons relating to the winner.

4. Disclaimer of Warranties
4.1 Youngcom points out that the availability and function of the competition cannot be guaranteed. The competition can be terminated or removed due to external circumstances or constraints without the participants being able to make any claims against Youngcom.
4.2 This can include technical problems, rule changes or decisions by platforms such as Facebook because the competition is also held on and in connection with them.

5. Liability
5.1 The following exclusions and limitations of liability shall apply to Youngcom’s liability for damages, notwithstanding the other statutory entitlement requirements under this Clause 5.
5.2 Youngcom is liable without limitation if the cause of the damage is due to intent or gross negligence.
5.3 Furthermore, Youngcom is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or the breach of obligations, the fulfillment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely. In this case, however, Youngcom is only liable for the foreseeable, contract-typical damage. Youngcom is not liable for the slightly negligent breach of obligations other than those specified in the preceding sentences.
5.4 The above limitations of liability do not apply in the event of injury to life, body and health, for a defect after the assumption of quality guarantees for the quality of a product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
5.5 Youngcom is not liable for material and/or legal defects in prizes
5.6 Insofar as Youngcom's liability is excluded or limited, this also applies to the personal liability of Youngcom's employees, representatives and vicarious agents.

6. Privacy Policy
6.1 Youngcom collects and uses the participants' data only to the extent permitted by law or where the participants consent to it.
6.2 The following data is collected from the participants by the organizer and is used to design, implement and process the competition: name of the participant, e-mail address, address, age, gender, region.
6.3 The participant data referred to in Section 6.2 will not be passed on directly to third parties or sold without their consent.
Exception: The participant's name and address will be passed on to companies that provide the prizes after contact has been made and separate consent has been given. These will be used exclusively for sending the prizes and will then be deleted.
6.4 The results of the voting are evaluated anonymously, ie Youngcom presents the data in such a way that personal information and contact details are not associated with the results of the voting. Only age, gender and region are saved and evaluated accordingly.
6.5 In response to requests in writing or in text form, the participants can request information at any time about which personal data is stored, can request their correction or deletion and revoke data usage consent.

7. Facebook Notices and Terms
7.1 In addition to these Conditions of Participation, the relationship between Youngcom, the participant and Facebook is governed by the Conditions of Participation (see https://www.facebook.com/terms.php) and the data protection rules of Facebook (see https://www.facebook.com/ privacy) determined.
7.2 The participants cannot assert any claims against Facebook that arise in connection with the use of the competition application or participation in the competition.
7.3 The participants acknowledge that neither the competition application nor the competition are in any way sponsored, endorsed or organized by Facebook or have any connection with Facebook.
7.4 All information and data provided by the participants through the use of the competition application or in the competition or collected by them will only be made available to Youngcom and not to Facebook.
7.5 All inquiries and information regarding the competition should be directed to Youngcom and not to Facebook.

8. Miscellaneous
8.1 These Conditions of Participation can be changed by Youngcom at any time without separate notification.
8.2 Should individual provisions be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
8.3 Legal recourse is excluded.
8.4 The law of the Federal Republic of Germany is exclusively applicable.
